Two persons, who defrauded a Kumasi-based businessman of GH¢1,700,000.00, have been jailed 10 years each in absentia by the Adentan Circuit Court.

Prince Kyei Bennett and Samuel Nutsugah collected the amount under the pretext of selling to the complainant, Eric Coffie, a schnapps bottle containing mercury.

Bennett, a 48-year-old businessman, and Nutsugah, 58-year-old unemployed, who were charged with conspiracy and defrauding by false pretences, pleaded not guilty, but they discontinued attending court.

The court presided over by Mrs Sedinam Awo Kwadam found them guilty after the prosecution, Chief Inspector  Maxwell Lanyo, filed disclosures and called witnesses.

The court sentenced accused to five years on the charge of conspiracy and 10 years each on the charge of defrauding by false pretences, to run concurrently.

Chief Insp Lanyo told the court that Bennett resided at Adjen Kotoku, in the Greater Accra, while Nutsugah lived in Kumasi, Ashanti Region.

The court heard that in April 2017, Nutsugah told the complainant that he was into selling bottles of schnapps containing mercy.

Chief Insp Lanyo said Nustugah introduced Bennett to complainant as his business partner.

The court heard that Nutsugah later told the complainant that he had obtained a bottle containing mercury.

Chief InspLanyo said Nutsugah told the complainant that the mercury in the bottle insufficient and there was the need for rituals to be performed so that it (bottle) could have full level of mercury.

The prosecution said Nutsugah told the complainant that if he (Nutsugah) was able to perform rituals for mercury to fill the bottle, he would take US$5 million and a four-bedroom house from complainant.

Chief Insp Lanyo said Bennett and Nutsugah collected GH¢1,700,000 from the complainant.

The court heard that Bennett and Nutsugah later brought a bag to the complainant, claiming it contained money.

Chief Insp Lanyo said Bennett and Nutsugah told the complainant they had sold the bottle to a spiritualist.

The court heard that accused told complainant that he could use money in the bag, only if they (accused) kept the bag in a

room and performed rituals.

Chief Insp Lanyo said the complainant took accused to a guest house at Adjiriganor, Accra, and kept the bag there.

The prosecution said Bennett and Nutsugah again demanded money from the complainant to be used for purification of the bag.

Chief Insp Lanyo said after taking the money from the complainant, accused asked complainant to provide a white dove, black and white ram, and other item, for rituals, which he did.

The prosecution said accused did not perform any rituals, claiming the dove complainant provided was painted.

Chief Insp Lanyo said the bag of money was abandoned at the hotel since the complainant could not complete the purification.

The prosecution said when the police retrieved the bag from the hotel, and was opened, they found sawdust.

Benettein a caution statement, admitted collecting GH¢800,000 from the complainant while Nutsugah claimed he could not remember the amount he took from the victim.
