The Food and Drugs Authority (FDA) has observed with concern the misrepresentation of the recent High Court ruling in the case of Tobinco Pharmaceuticals Ltd. v. The Food and Drugs Authority in some media reports.
Specifically, it has been inaccurately suggested that the current CEO, Dr. Delese Darko, exhibited negligence, leading to the Authority’s loss in this case.
According to the Food and Drugs Authority in a statement, this legal matter originates from actions taken in 2013. Despite claims made by Tobinco Pharmaceuticals Ltd. against the then-CEO, Dr. Stephen Opuni, the current FDA leadership has consistently provided a robust defense throughout the court proceedings.
The lawsuit initiated against the FDA in 2019 has been met with a thorough and determined response by the Authority at all stages.
“While the FDA acknowledges the judgment delivered by the High Court, the Authority respectfully disagrees with the decision and plans to exercise its right to appeal’.
The FDA remains steadfast in its commitment to upholding the judicial process, adhering to the rule of law, and ensuring that due process is followed until the matter reaches a final resolution.
