Justice Issifu Omoro Tanko Amadu of the Supreme Court has introduced the 5th Edition of the Manual on Elections Adjudication, which clarifies voting rights for prisoners in Ghana.
Justice Amadu, who also serves as the Director of the Judicial Training Institute and a member of the Election Management Committee, highlighted the new edition’s updates and expanded guidelines for handling election disputes during its launch.
The 5th Edition, now published in three volumes, offers detailed insights into Ghana’s legal framework surrounding elections, with specific chapters dedicated to various election-related disputes.
It includes a discussion on the constitutional right to vote, covering both presidential and parliamentary elections, and emphasizes the importance of upholding voting rights, including for those incarcerated.
Justice Amadu underscored the manual’s broader value, as it not only informs judicial authorities on procedures but also provides guidance for stakeholders, including election management bodies, legal practitioners, and the general public.
The updated edition also addresses several critical issues, including challenges to voter registration, the conduct of the Electoral Commission, and the protection of constitutional rights.
Key sections include:
- Chapter 1: Provides an overview of Ghana’s legal approach to election disputes, emphasizing the rule of law.
- Chapter 3: Discusses voting rights in both presidential and parliamentary elections.
- Chapter 5: Details guidelines for petitioning in parliamentary election disputes.
- Chapter 8: Focuses on regulatory updates from the recent Constitutional Instrument (C.I. 91) amendments that outline processes in the event of a disputed election outcome.
In his closing remarks, Justice Amadu expressed confidence that this latest edition would serve as an invaluable resource, helping ensure that Ghana’s election adjudication processes meet international standards.
