Suspended CJ Alleges Unfair The Attorney-General has initiated legal action at the High Court’s Human Rights Division to dismiss the judicial review application filed by suspended Chief Justice Gertrude Torkornoo.
The motion argues that the application is fundamentally flawed on legal grounds.
Last week, Chief Justice Torkornoo directed her legal team to seek judicial review, aiming to have the ongoing impeachment proceedings against her declared unlawful and nullified.
At a press conference in Accra on June 25, she criticized the committee conducting the inquiry under Article 146 of the Constitution, describing the process as lacking adherence to fair hearing principles.
In response, the Attorney-General’s office, through a sworn affidavit by State Attorney Reginald Nii Odoi, contends that the application suffers from a “grave misstatement of capacity” and omits necessary parties, making it legally defective.
The affidavit further asserts that the issues raised have either been resolved by the Supreme Court or are currently under its consideration.
The Attorney-General maintains that the Human Rights Division lacks jurisdiction over the matter and cautions that entertaining the application would amount to judicial overreach, contravening established Supreme Court rulings.
