The Minority in Parliament has strongly condemned the Attorney-General’s decision to discontinue the prosecution in the case of The Republic vs. Kwabena Duffour and seven others through a nolle prosequi.
The decision was officially announced last week by the Attorney-General’s Office, highlighting that about 60% of the contested funds had been recovered, thereby negating the need to continue the trial.
At a press briefing held in Parliament, Minority Spokesperson on Constitutional and Legal Affairs, Kwame Anyimadu, criticized the Attorney-General’s move as an affront to justice and a risk to public accountability.
He urged the Parliamentary Select Committee on Constitutional, Legal and Parliamentary Affairs to summon the Attorney-General, Dr. Dominic Ayine, to provide a public explanation for his decision.
He stated, “We are calling on the Parliament of Ghana, particularly the Select Committee on Constitutional, Legal and Parliamentary Affairs, to summon the Attorney General to publicly answer for this decision.”
Anyimadu emphasized that this development signals a dangerous politicization of the prosecution process, calling on all patriotic citizens to oppose what he described as the erosion of justice.
He remarked “All patriotic Ghanaians must stand up against what appears to be the erosion of justice and the dangerous politicization of the prosecutorial process.”
He also warned that if the Attorney-General does not reconsider the withdrawal, the Minority is prepared to take legal action to challenge the decision in court.
“Let this press conference also serve as formal notice to the Attorney General, Dr. Dominic Ayine, that if his decision is not reversed, the Minority will consider its options, including legal action to challenge the decision in its entirety,” he hinted.
Highlighting the principle of fairness in the judicial process, Mr. Anyimadu concluded, “Justice must not only be done, but it must be manifestly seen to be done,” underscoring the importance of transparency and accountability in legal proceedings.
