The Minister for Information, Felix Kwakye Ofosu, has clarified that a petition filed against Supreme Court Justice Yonny Kulendi did not establish a prima facie case, following constitutional review processes.
In a Facebook post on Tuesday, Mr Kwakye Ofosu outlined the steps taken after the petition was submitted, stressing that due process was followed in line with Article 146 of the 1992 Constitution.
According to the minister, the President forwarded the petition to the Chief Justice to determine whether it disclosed a prima facie case that would warrant further action.
He explained that the Chief Justice subsequently wrote to the President, indicating that the petition did not meet the constitutional threshold of a prima facie case.
“The President has communicated what the Chief Justice said to the petitioner,” Mr Kwakye Ofosu stated, adding that the matter had therefore been dealt with in accordance with established legal and constitutional procedures.
The clarification comes amid public discussion and commentary surrounding the petition against Justice Kulendi, with the Information Minister seeking to provide factual context and assure the public that the rule of law and constitutional safeguards were upheld.
Justice Yonny Kulendi is a Justice of the Supreme Court, and petitions against superior court judges are governed by strict constitutional provisions to protect judicial independence while ensuring accountability.
