Felix Kwakye Ofosu, Minister of Government Communications, has emphatically stated that no public officer in Ghana, including the President of the Republic, is above the law.

His remarks come in response to recent comments made by the suspended Chief Justice, Her Ladyship Gertrude Araba Torkornoo, who described the presidential committee investigating her as unconstitutional during a press briefing.

Speaking to the media shortly after the Chief Justice’s press conference, Kwakye Ofosu underscored the principle that all public officials are bound by Ghanaian law without exception.

He stressed the importance of transparency and adherence to legal processes in state affairs.

“It is unacceptable to harbor a secret current mentality in handling state matters,” Kwakye Ofosu stated adding “Every single public official from the president to the speaker, to the chief justice, to Supreme Court judges, to ministers, to all public office holders are bound by the provisions of Ghanaian law. Indeed, it was the former Australian Prime Minister, Kevin Rudd, who once said that ‘when you join the game, you play by the rules’.”

The Minister reiterated that no individual, regardless of their position or sensitivity of their office, is exempt from legal scrutiny.

“Once Ghanaian law mandates certain procedures for alleged misconduct, those rules must be followed,” he stressed.

Kwakye Ofosu further defended President Mahama’s handling of the investigation, describing it as consistent with constitutional principles.

“This is the only guiding principle the President has operated by throughout this process,” he said.

He dismissed claims suggesting political motives behind the investigation as baseless and unfounded.

“Any inference or imputation of political bias against the President is false and cannot be allowed to stand. I wish to place that firmly on record.”

The Minister also highlighted that no evidence of wrongdoing has yet been presented against the suspended Chief Justice.

“As of now, absolutely no evidence of sin has been established in any form. I strongly reject any attempts to politicize this matter.”

Expressing regret over the Chief Justice’s public comments, Kwakye Ofosu noted that her statements echoed opposition rhetoric, which he described as unfortunate.

“Unfortunately, Her Ladyship the Chief Justice herself has added to this commentary, which initially was the tone of elements of the opposition. And it is deeply regrettable that this should happen when the president has been above board and conducted himself in straight compliance with the constitution of Ghana.”
