Frank Davis, the legal representative of former Finance Minister Ken Ofori Atta, has dismissed threats from the Special Prosecutor, asserting that his client is not intimidated by ongoing investigations.
In an interview on JoyFM Topstory monitored by Kumasimail, Davis termed as “childish prank” the assertion by Special Prosecutor Kissi Agyabeng that Ofori Atta should voluntarily return to Ghana or risk being forcibly brought back.
Davis stated, “Ken Ofori Atta, either you come into this country or I will force your entry. Come on, these are immature, childish pranks.”
He emphasized, “Look, nobody is afraid of prosecution. Let me tell you. Ken Nana Yaw Kuntunkununku Ofori Atta is not afraid of prosecution.”
He further criticized the theatrics surrounding the case, urging the authorities to focus on their official duties rather than theatrics.
“The accused will have his day in court,” Davis added.
He also pointed out that the Special Prosecutor should be more concerned about the integrity of his office and public perception, rather than issuing threats.
“A lawyer’s place is in the courtroom,” Davis concluded.
Background:
Special Prosecutor Kissi Agyabeng at a press conference announced the intention to charge former Finance Minister Ken Ofori-Atta along with other former Ghana Revenue Authority (GRA) officials over contracts awarded to Strategic Mobilisation Ghana Limited (SML).
He revealed that investigations showed these contracts were unnecessary, unlawfully approved, and resulted in significant financial losses to the state.
According to Agyabeng, the contracts arose from self-serving patronage based on false and unverified claims with mandatory approval processes bypassed, reflecting increased impunity.
He also highlighted the lack of financial oversight, with payments made automatically disconnected from actual work, undermining due process and accountability in public procurement.
Agyabeng further indicated that if Ken Ofori-Atta does not voluntarily return to Ghana, efforts would be made to forcibly bring him back to face prosecution.
The Special Prosecutor emphasized the seriousness of the case and the commitment to ensuring those responsible are held accountable in court.
