“Supreme Court dismisses Kwame Adofo’s certiorari application, orders GH₵20,000 cost for frivolous case”

The Supreme Court of Ghana, on Tuesday, 15th October 2024, dismissed an application filed by Kwame Adofo, the former lawyer for Komfo Anokye Teaching Hospital (KATH).

Mr. Adofo, while still under contract with the hospital, had engaged in a series of actions against the institution and its Chief Executive. This behavior led KATH’s management to report him to the General Legal Council, seeking an investigation and appropriate sanctions for his unprofessional conduct.

Despite the ongoing complaint with the General Legal Council, Mr. Adofo continued to criticize the hospital and its Chief Executive, publicly releasing confidential information about the hospital. This was in violation of a confidentiality agreement he had signed as part of his role as KATH’s legal representative.

In response to these actions, KATH decided to take legal action against him in the High Court, seeking damages for breaching the duty of trust he owed to the hospital. The hospital argued that Mr. Adofo had betrayed its interests by disclosing sensitive information that he had access to during his tenure as its lawyer.

Instead of defending the suit in the High Court, Mr. Adofo filed an application claiming the court lacked jurisdiction to hear the case, arguing that the matter had already been referred to the General Legal Council. The High Court dismissed this application and ordered him to pay costs.

Unhappy with the High Court’s decision, Mr. Adofo escalated the matter to the Supreme Court. However, the Supreme Court also rejected his application, labeling it frivolous and a poor understanding of legal principles. The court further ordered him to pay GH₵20,000 in costs for wasting the court’s time.

KATH was represented in court by its current lawyer, Nana Freduah Agyeman Osborn Esq.
