The Tamale High Court has ordered a rerun of the Kpandai parliamentary election, directing that a fresh poll be conducted within 30 days. The ruling was delivered by His Lordship Justice Emmanuel Brew Plange following a petition challenging the credibility of the 2024 parliamentary results.
The petition was filed by former Member of Parliament and National Democratic Congress (NDC) parliamentary candidate, Daniel Nsala Wakpal, who contested the election of Matthew Nyindam as the validly elected MP for the constituency.
Wakpal argued that the parliamentary election held on December 7, 2024, was fraught with irregularities and inconsistencies, particularly in Form 8A (Regulation 32(7) and 39(2) Statement of Polls for Member of Parliament, also known as the pink sheet) across 41 out of 152 polling stations in the constituency.
According to him, the election was not conducted in compliance with Regulation 39 of the Public Elections Regulations, 2020 (CI 127), and the breaches significantly affected the overall outcome of the poll.
He further contended that the declaration and publication of results also failed to meet the requirements of Regulation 43 of CI 127, thereby undermining the integrity of the final results.
Wakpal subsequently sought an order to overturn the declared results from the affected polling stations and requested a rerun in those locations.
In delivering his judgment, Justice Plange upheld the petitioner’s claims and ruled that the Electoral Commission must organise a new election to determine the legitimate winner of the Kpandai parliamentary seat.
The Electoral Commission is expected to announce the date for the rerun in accordance with the court’s 30-day directive.
