Former Board Chairman of Ghana Infrastructure Investment Fund, Prof. Christopher Ameyaw-Akumfi has filed motion to stop his criminal charges describing it as premature.
Consequent to this application, the former Board Chairman is also seeking the Supreme Court intervention.
In an application filed on Tuesday, June 24, lawyers of the 80-year-old former government official want “An order striking-out the action against the accused as premature and in violation of a legal condition precedent imposed on the prosecution.
“An order referring ot the Supreme Court of Ghana, pursuant ot Article 130(2) of the 1992 Constitution, the constitutional question that arises as to the proper construction and application of Sections 1 and 7 of the Public
Property Protection Decree, 1977 (SMCD 140), vis-à-vis the fair triad guarantees under Article 19 and the standards governing the exercise of prosecutorial discretion under Article 296 of the Constitution.
“A consequential order staying proceedings before this Honorable Court pending the final determination of the constitutional question by the Supreme Court,” he stated.
Prof. Ameyaw-Ekumfi and former Chief Executive of Officer of GIIF, Solomon Asamoah have pleaded not guilty to six charges including willfully causing financial losses to the tune $2 million in the sky train project.
