The Republic of Ghana, through the Attorney General, has urged the ECOWAS Community Court of Justice to dismiss in its “entirety” an action by former Chief Justice Gertrude Sackey Torkornoo, who is seeking enforcement remedies of her removal.
The former Chief Justice is challenging her suspension and subsequent removal for stated misbehaviour from office at the ECOWAS Court
But the AG, through the Deputy AG, Dr. Justice Srem-Sai, in an amended Statement of Defence filed on March 24 and adopted by the Court on March 25, urged the Court to dismiss the action from Ghana’s former Chief Justice.
The latest response from Ghana is in direct response to Justice Torkornoo’s amended action in December last year to what she filed in July 2025, prior to her removal in September the same year.
In the amended Statement of Defence to the former CJ’s action, the Republic of Ghana is asking the ECOWAS Court for:
a. A DECLARATION that the Application is inadmissible or, in the alternative, without merit, on the ground that the Applicant was afforded a fair hearing in accordance with due process throughout the constitutional removal proceedings,
b. A DECLARATION that there has been no violation of the Applicant’s right to fair hearing and due process under Article 7 of the African Charter on Human and Peoples’ Rights,
c. A DECLARATION that there has been no violation of the Applicant’s right to information under Article 9 of the African Charter on Human and Peoples’ Rights,
d. A DECLARATION that there has been no violation of the Applicant’s right to dignity and protection from arbitrary treatment under Article 5 of the African Charter on Human and Peoples’ Rights,
e. A DECLARATION that there has been no violation of the Applicant’s right to work under Article 15 of the African Charter on Human and Peoples’ Rights, and
f. AN ORDER dismissing the Application in its entirety.
