Defence lawyers in the Sky Train case have filed a motion to compel 14 officials to be cross-examined by accused persons as part of their defence.
The move was disclosed in court on Monday, October 5, 2026 when the matter was called on the first day of the 2026/2027 Legal year for Case Management Conference.
Lead counsel for the former Chief Executive Officer of the Ghana Infrastructure Investment Fund (GIIF), Solomon Asamoah, Victoria Barth, told the court her client has invoked the supervisory jurisdiction of the Supreme Court.
According to her, an application for certiorari and prohibition has been filed seeking an order to restrain the High Court from further hearing the matter, with a return date of Tuesday, October 13.
She said to show good faith and to dispel any perception that the first accused has no defence or is only seeking to delay the trial, the defence filed its witness statement on September 23, 2026, and subsequently filed 14 subpoenas on October 2 in respect of persons they intend to cross-examine.
“We are praying the court to take into consideration the fact that the return date is October 13 and to kindly indulge us a short adjournment for the Supreme Court to hear us, as any further steps taken beyond the show of good faith will compromise A1 and render his application moot,” she submitted.
She added that two other witnesses who are outside the jurisdiction would have their statements filed later with the leave of the court.
Counsel for the former Board Chairman of GIIF, Prof. Christopher Ameyaw-Akumfi, Yaw Acheampong Boafo, associated himself with the submission.
Chief State Attorney, Sefakor Batse said the prosecution has been served with the witness statement of the second accused, but is yet to receive that of the first accused and the processes he claims to have filed.
She reminded the court that processes filed at the Supreme Court do not stay proceedings in the High Court, but left the decision on adjournment to the court.
The court, after listening to all parties, adjourned the case to Monday, October 19 at 10 a.m.
Background
Former Chief Executive Officer of the Ghana Infrastructure Investment Fund (GIIF), Solomon Asamoah and former Board Chair of the Fund Prof. Christopher Ameyaw-Akumfi, are facing charges for allegedly causing financial loss for disbursing $2 million for a Skytrain project without Board approval.
They have pleaded not guilty to a combined six counts, which comprised conspiracy, wilfully causing financial loss to the Republic, and intentional dissipation of public funds, and have been granted bail.
The Prosecution called 3 witnesses namely, Yaw Odame-Darkwa, a former Board Member of GIIF, Kofi Boakye, a Lawyer and acting Board Secretary of GIIF and Francis Aboagye, a Staff Officer at the National Intelligence Bureau who led the investigations.
All 3 witnesses testified variously to the effect that the Board did not approved the Skytrain project which the accused persons allegedly disbursed $2 million for.
Following the closure of the Prosecution’s case, laywers for the accused persons, filed submission of no case and was dismissed.
The Court presided over by Her Ladyship Justice Audrey Kocuvie-Tay, following the dismissal ordered them to file their witness statements to open their defense.
Solomon Asamoah, the former GIIF Chief Executive Officer, and Prof. Christopher Ameyaw-Akumfi, a former Board Chairman of GIIF, have been charged for their role in the dissipation of the $2 million state funds over the Sky Train Project.
