The Supreme Court has unanimously set aside a Court of Appeal ruling that ordered the reinstatement of Nii Adama Latse II as the Ga Mantse.
In a decision delivered by a five-member panel presided over by Justice Gabriel Pwamang, the apex court held that the Court of Appeal’s June 12, 2024 judgment violated the right to natural justice of King Tackie Teiko Tsuru II.
The ruling means King Tackie Teiko Tsuru II remains the officially recognized Ga Mantse.
Lawyers for King Tackie Teiko Tsuru II had filed an application for certiorari challenging the Court of Appeal’s decision. That application was opposed by lawyers representing Nii Adama Latse II.
The Court of Appeal had earlier ruled that Nii Adama Latse II’s removal from the national register of chiefs was unlawful, as there was no evidence of a valid destoolment. However, the Supreme Court’s decision has now nullified that ruling, maintaining the status quo while allowing room for further legal processes.
Before quashing the Court of Appeal’s decision, the Supreme Court also set aside an earlier ruling by the Kumasi High Court dated November 11, 2021.
King Tackie Teiko Tsuru II attended the hearing with a large entourage.
The panel that delivered the ruling included Justice Ernest Gaewu, Justice Richard Adjei-Frimpong, Justice Gbiel Simon Suurbaareh, and Justice Philip Bright Mensah.
