President John Dramani Mahama has removed Chief Justice Gertrude Araba Esaaba Sackey Torkonoo from office, following recommendations by a constitutional committee established to investigate a misconduct petition against her.
A statement from the Presidency on Monday said the decision was taken in line with Article 146(9) of the 1992 Constitution, which obliges the President to act on the findings of such a committee.
The committee, set up under Article 146(6), was tasked to inquire into a petition filed by Ghanaian citizen Daniel Ofori. After reviewing the evidence, the committee concluded that Justice Torkonoo had engaged in “stated misbehaviour” as defined under Article 146(1) of the Constitution. It therefore recommended her removal from office.
President Mahama, in accordance with constitutional provisions, endorsed the recommendation, bringing Justice Torkonoo’s tenure as head of the Judiciary to an end with immediate effect.
Justice Torkonoo, who was appointed Chief Justice in June 2023, becomes the second head of Ghana’s judiciary to be removed from office under constitutional provisions.
