The Court of Appeal has dismissed an application for stay of proceedings filed by former Board Chairman of the Ghana Infrastructure Investment Fund (GIIF), Prof. Christopher Ameyaw-Ekumfi, in the ongoing SkyTrain trial.
The three-member panel, presided over by Justice Georgina Mensah-Datsa, with Justice Kwasi Anokye Gyimah and Justice Franklina Gesila Adanu as members, unanimously dismissed the application.
Prof. Ameyaw-Ekumfi, who is the second accused person in the case, was asking the Court to halt proceedings at the High Court pending the determination of his appeal against the High Court’s dismissal of his submission of no case.
In its ruling, the Court held that the applicant had failed to demonstrate any exceptional circumstances to warrant the grant of the relief sought.
It therefore ordered that the trial should continue in its normal course.
With both the injunction application by the first accused and the stay application by the second accused now out of the way, the accused persons are expected to file their defences by September 23, 2026 for the trial to continue before Justice Audrey Kocuvie-Tay.
They have pleaded not guilty to a combined six counts including willfully causing financial loss to public property and are on bail.
Prosecution had closed its case after calling four witnesses while the Court had ordered them to open their defence after establishing a prima facie evidence against them in the role leading to the loss of $2 million.
