The High Court in Accra has dismissed, as without merit, an application by Godfred Yeboah Dame seeking to throw out charges against former NAFCO CEO Hanan Abdul-Wahab Aludiba.
This was after lawyers for the former NAFCO CEO, on Tuesday, July 21, moved an application for the charges against their client to be struck out.
They argued that the charges were fatally defective and in contravention of his right to a fair trial.
But the Republic, represented by Deputy Attorney General Dr. Justice Srem-Sai, opposed the application, arguing that the charges before the court are proper and clear and that the accused should be made to stand trial.
Justice Francis Apangabonu Achibonga, a Justice of the Court of Appeal sitting as an additional High Court judge, ruled that the charges are fit for the accused person to stand trial.
However, out of the 16 counts to which he had pleaded not guilty, the court said the prosecution should amend Counts 9 and 14.
