The High Court has dismissed an application for an interlocutory injunction filed by the Ship Owners and Agents Association of Ghana (SOAAG) and some shipping agents seeking to stop the implementation of the Ghana Shippers’ Authority’s (GSA) directive capping the Container Administrative Charge (CAC) at GH¢720 per Twenty-foot Equivalent Unit (TEU).
The ruling, delivered on Friday, July 10, 2026, clears the way for the continued enforcement of the GSA’s Regulatory Directive issued on May 11, 2026.
According to a press statement issued by the Ghana Shippers’ Authority on Monday, the court held that the directive had already taken effect upon its issuance and, therefore, declined to grant the injunction sought by the applicants.
The court further observed that granting the application would interfere with the Authority’s statutory mandate to regulate the commercial shipping industry.
With the dismissal of the injunction application, the GSA said the directive remains valid, operational, and fully enforceable.
The Authority has consequently directed all shipping lines and their agents to comply immediately with the directive, which sets the maximum Container Administrative Charge at GH¢720 per TEU.
It warned that any shipping line or agent that fails to comply would face regulatory and enforcement actions under Sections 36 and 47 of the Ghana Shippers’ Authority Act, 2024 (Act 1122), as well as any other applicable laws.
The GSA also urged importers, exporters, freight forwarders, and other stakeholders in the shipping industry to report any instances of non-compliance through its established complaint and reporting channels to facilitate appropriate regulatory action.
Reaffirming its commitment to the industry, the Authority said it would continue to balance the interests of shippers and shipping lines while promoting transparency, fairness, and constructive dialogue among stakeholders.
It added that the enforcement of the directive aligns with the government’s broader objective of reducing the cost of doing business in Ghana and ensuring a more efficient and competitive commercial shipping sector.
